Terms of Service
These terms set out the rights, obligations, and responsibilities of the company and its members in using fromband. If the Korean and English versions differ, the Korean version prevails.Article 1 (Purpose)
These terms set out the conditions and procedures for using the fromband website and app (the "Service") operated by Peterlabs (the "Company"), and the rights, obligations, and responsibilities of the Company and its members.Article 2 (Definitions)
•"Member" means a person who agrees to these terms and creates an account.
•"Artist" means a member who creates an artist page on the Service and uploads music and posts.
•"Content" means any material a member uploads to the Service, including audio, images, lyrics, posts, and comments.
•"Paid services" means services used for a fee, including artist plans, ad-free listening (Ad-Free), fan memberships, and track purchases.
Article 3 (Posting and changing these terms)
The Company posts these terms on the Service. The Company may change them within the limits of applicable law and announces the changes and their effective date at least 7 days in advance. Changes unfavorable to members are announced at least 30 days in advance and notified individually, such as by email.A member who does not agree to the changed terms may stop using the Service and close their account. Continuing to use the Service after the effective date means agreeing to the changed terms.Article 4 (Membership and accounts)
•You can sign up with email verification or by connecting a Google account, and you must agree to these terms and the Privacy Policy.
•Children under 14 cannot become members.
•Members must provide accurate information and must not use another person's information or impersonate anyone.
•Members are responsible for keeping their account and sign-in methods (email, passkeys, and the like) secure, and must tell the Company immediately if they suspect misuse.
Article 5 (Providing and changing the Service)
The Company provides music listening, artist pages, track uploads and visibility settings, follows, notifications, community features, and paid services.The Company may change or discontinue parts of the Service for operational or technical reasons. Changes with a significant effect on members are announced in advance, or afterwards when advance notice is impossible.The Service may be temporarily unavailable because of maintenance, outages, natural disasters, or other unavoidable causes.Article 6 (Paid services and payment)
•The type, price, period, and benefits of each paid service are shown on the Service before payment.
•Payments are made through the payment processors the Company designates (such as Stripe) or app stores (Apple App Store, Google Play). The Company does not store card details.
•Recurring plans renew automatically each billing period until the member cancels. After cancelling, the member keeps access until the end of the paid period and is not charged again.
•Artists set the prices of fan memberships and tracks. The Company processes the payment and pays the artist the amount after its stated fees.
Article 7 (Withdrawal and refunds)
•Members may withdraw a purchase within 7 days of payment as provided by applicable law.
•Withdrawal may be limited for digital content whose use has begun, such as a download or streaming, when this was disclosed before payment.
•When a recurring plan is cancelled after partial use, the Company refunds the amount for the unused period under applicable law and the terms shown at checkout.
•Purchases made through an app store follow that store's refund policy.
•Refunds go back to the original payment method. Requests can be sent through Contact us in the Help center.
Article 8 (Rights in content and license)
•Copyright in content a member uploads stays with its rights holders. The Company does not take ownership of any content.
•Members grant the Company a worldwide, royalty-free, non-exclusive license to store, copy, convert (such as encoding and creating thumbnails), transmit, and publicly display their content to the extent needed to operate, provide, and promote the Service. The license ends for content the member deletes or makes private.
•Members warrant that they hold all rights their content needs, including composition, lyrics, arrangement, performance, and recording rights, and any permission a cover or remix requires.
•Sales or usage conditions a member sets on the Service apply to buyers and users of that content.
Article 9 (Infringement reports and takedowns)
Anyone who believes their rights are infringed can request a takedown through Report copyright in the Help center. Under the Copyright Act and other applicable law, the Company temporarily makes the content private and notifies the uploader, who may request reinstatement.Members who repeatedly infringe may have their use restricted or their account terminated.Article 10 (Prohibited conduct)
Members must not:•Upload content that infringes others' copyrights, trademarks, publicity rights, or other rights
•Impersonate another person or artist
•Upload sexually explicit, hateful, violent, or illegal content
•Manipulate plays, followers, rankings, or similar figures through automation or other improper means
•Crawl or copy the Service without permission, or download and distribute audio without permission
•Circumvent the Service's security or interfere with its normal operation
•Send advertising, spam, phishing, or anything else that harms other members
Article 11 (Restrictions and termination)
•Members may request to close their account at any time through Contact us in the Help center, and the Company processes the request without delay.
•If a member violates these terms or applicable law, the Company may make content private, restrict features, suspend use, or terminate the account, depending on the severity.
•The Company tells the member why their use is restricted, and the member may object through the Help center.
Article 12 (The Company's obligations)
The Company complies with applicable law and these terms and works to provide the Service reliably. It protects members' personal information under the Privacy Policy and handles members' legitimate opinions and complaints promptly.Article 13 (Limitation of liability)
•The Company is not liable for damage caused by events beyond its control, such as natural disasters, the member's own fault, or outages at third-party services (payment processors, cloud providers, and the like).
•Members are responsible for the accuracy and lawfulness of the content they upload.
•Disputes between members, or between a member and a third party, arising through the Service are in principle resolved between the parties.
•This article does not apply to damage caused by the Company's intent or gross negligence.
Article 14 (Governing law and jurisdiction)
These terms are governed by the laws of the Republic of Korea. Lawsuits between the Company and a member about the Service are brought before the court with jurisdiction under the Civil Procedure Act.Business information
